    I disagree a little bit - this will help people in EB3 indirectly
    A lot of people in EB2 and EB3 can qualify for auto adjustment of status now, so it will remove people from EB3 queue making it smaller.

    Whats ur PD? U r not current in Aug right?

    No. It is a good company and are very careful with things. I have never been in consulting. One good thing they did unlike other companies is they anticipated career growth and filed GC for a higher position and I could gladly accept promotion in my career.

    I thought that we have to send our I-485 applications to NSC regardless of which state you are from.

    Is that not true? How come your friend sent it to TSC?

    Also, what do you mean by "Nebraska had a 6 day lag till Jan 1st"?

    It depends on where ur I140 approval came from. What I mean by lag is they receive the application on 1st jun, they are working on assigning the lin # after 6 days. If they were at the same pace they should start working on the new I485 recived on Jun 1st today.

    My PD is Oct 2006. Its seems like i have to wait around 10+ years. Do you think i should go for EAD instead of H1B transfer and H1B extension

    I think you will get in less than 2 years. It will not take 10 years. Hang on. Total GC process time from applying to labor to getting GC usually is 4 years. some unlucky people had to wait more than that. But more than 80% fall in to 4 year time line.

    but some were lucky people got it quickly because they could cut lines.

    Compete America Praises Introduction of Cornyn Legislation to Reform H-1B and Green Card Systems

    'SKIL Bill' Would Relieve Crisis Facing U.S. Employers of Highly Educated Foreign Nationals

    Washington D.C. - Compete America today praised the introduction of the "SKIL Bill" by Senator John Cornyn (R-TX) to reform both the H-1B visa and employment based (EB visa) green card processes. The legislation is cosponsored by Senators Allard (R-CO), Allen (R-VA), Bennett (R-UT), Enzi (R-WY), and Lott (R-MS).

    The SKIL Bill is the latest indicator that both the United States Senate and the Bush Administration are prepared to fix the visa system for highly educated foreign nationals. In addition to the SKIL Bill, Compete America has endorsed measures contained the Senate's comprehensive immigration legislation addressing H-1B and EB visa issues; and has also endorsed President Bush's call to ensure access to talent as part of the Administration's American Competitiveness Initiative.

    "Senator Cornyn clearly understands the contribution highly-educated foreign nationals make to the U.S. economy and to Texas," said Texas Instruments CEO and President Richard K. Templeton. "The Senator's bill reaffirms America's proud tradition of welcoming top talent to this country. The reality is that most scientists and engineers with advanced degrees from U.S. universities are foreign born. The competition for talent is truly global. If the U.S. wants to win, we absolutely must encourage these advanced degree holders to stay here and get their green cards - not send them home to compete against us. The 'SKIL' bill really advances that goal."

    Both the H-1B and EB visa/green card programs have been responsible for bringing much needed foreign talent to live and work in the United States, and most importantly, to make significant contributions to the U.S. economy and global competitiveness. However, H-1B shortages have been well documented, and backlogs in the green card system are getting worse, forcing thousands of valued foreign-born professionals - including researchers, scientists, teachers and engineers - into legal and professional limbo for seven years or more.

    Among the provisions of the SKIL Bill (Securing Knowledge Innovation and Leadership) endorsed by Compete America are the following:


    Exemptions for U.S. educated foreign workers with advanced degrees in math, science, technology and engineering fields from the H-1B and EB quotas so their talent can be retained in the United States.

    Creation of a flexible, market-based H-1B cap so that U.S. employers are not locked out of hiring critical talent.

    Extension of foreign students' post curricular optional practical training from 12 months to 24 months to allow them to go more easily from student to green card.

    Exemptions for EB/green card immigrant spouses and children from the annual cap, thus making more visas available for the professionals we need.
    The SKIL Bill contains many of the provisions for reform of the H-1B visa and EB/green card systems that are present in the two versions of comprehensive immigration reform introduced by Senate Majority Leader Bill Frist (R-TN) and Senate Judiciary Committee Chairman Arlen Specter (R-PA).

    "The Senate is ready to address the problem facing U.S. employers of highly educated foreign nationals," said Sandra Boyd, National Association of Manufacturers Human Resources Policy Vice President and Compete America Chair. "It is incomprehensible that Congress would address broad immigration reform without fixing the system that brings legal, highly educated workers to the U.S. We are grateful to Senator Cornyn and the other cosponsors of the SKIL bill as well as those who have supported the inclusion of similar provisions in comprehensive immigration reform."

    It took more or less 30 days to process my filing, and hopefully you will see that happening as well.

    Guys,
    Ms. Susan Henner, the greatest attorney and person, who help us with free advise, was kind enough to provide me with a contact info to reporter from a Journal News. I spent an hour on the phone with her and explained her the whole story, the problems and our flower campaign. Tomorrow, I will get photographed and we will get in-depth publication on Wendsday.

    I looked at both the service center webpages(texas & nebraska) & I-485 application has to be sent to Nebraska only.I do not understand now why they are transferring the application from nebraska to Texas
    if I-140 is approved at Texas.
    Has anyone have any idea?

    I completely understand your pain. I have been here since 1998 and have a EB2 PD of 2002. And the dates are back to 2000. It seems like I can never get the ducks in a row. First my case gets stuck in PBEC. It take me 4+ years to get out of it. Then the RD at NSC is not current. When the RD turns current the PD retrogresses. Off course not to mention that I am waiting for name check to clear. The process is not linear. Some ppl are able to get thru it all in a very short time and some are stuck for years and years.

    I have gone thru some of the depression that you talk about. The only way out for me to realize was that either I take it or leave it. That's how I view the whole process. If I am going to take it then I need to have a plan for what I am going to do with my GC. I know one thing for sure, I am going to take a long vacation as soon as I get it :) Just getting too old and tired for the same old same old.


    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    But please, just trying to beat around the bush is not going to help anyone here for that matter not just me alone. You suggestion of sending flowers seems like that is the only solution to all the problems. I would say the reversal of the July 2 visa bulletine didn't just happen because of the flowers the members sent, the law suit AILA wanted to file against USCIS was one of the major reason apart from the California's Lawmakers letter. So please don't try to cut peoples idea by trying to belittle them, if you don't agree with them it is ok, if everyone agreed on the same thing life will be so dull.

    Your post is highly misinformed and members aren't surprised by your lack of correct information, you mention in your profile that you don't want to volunteer and you didn't attend the DC rally. No wonder you are disconnected from reality about how far IV has come. It is a fact and all members know this, IV scooped the July visa reversal news.

    Please stop living in the blunderland and face the reality. IV was a big reason, we never clam to be the sole reason. We work with other stakeholders. Without a grassroot effort none of the other constituents would have been effective. You mention about the AILA lawsuit "threat," well, why didn't they actually file the lawsuit? We agree that the lawmaker's letter was instrumental in the July visa fiasco reversal. We had an unprecedented San Jose rally by legal immigrants.

    You need to get serious and need to contact your state chapter leader to get some more information about IV.
    Stop misinforming others! It is about time IVers realized their infuence and exploit their full potential. Don't let such misinformed comments affect your efforts.

    Yes .. you can start a company on h1 ..
    but as per h1 laws .. you can only work for your employer
    So essentially you cannot do any work for your company .. no soliciting business, HR .. nothing.
    So what you do is partner with someone who is on GC .. so you can get work done .. or hire employees for everything.

    Starting company is easy LLC, C, S corp .. no issues

    I will also suggest guys waiting with their PD current to write to the USCIS Director in DC. I did that; not sure if that worked in my case, but one needs to explore every way of bringing their case to the attention of the management.

    Question remains.. Why ? Why people dont do what is expected when they know that these initiatives are going to help them?

    There was a thread poll for another rally, but how many members came forward? How many IV members made an effort to convince others to vote on that poll so that IV core can plan for a rally?
