It may be better if you refile it now (before Aug 17). My lawyer made me refile...just because there is no receipt yet. He says by doing so you don't lose anything. If your first application is in the system at the time of opening second, it will be returned. It is very unlikely that they will cash second check. Fedex confirmation only tells that 'something' was delivered. It does not tell what was inside...

well, the question then would be, has anyone been denied after presenting an EVL which states the employee is a consultant ?

Looks like this is a good idea. Even if FB2 is not current, USCIS might allow applying for 485 in such cases.
Maybe someone more knowledgable or from the core members can throw some light on this.

PS: I did NOT open any SR or contact seneator or ask lawyer to get in touch with USCIS. Just waited patiently. Did my Finger Printing in October 2007. No FP after that did paper filing for EAD & AP so no FP for those as well. My advise is to hang in there. Not to open too many SR's but thats entirely upto your discretion. Some people swear it helped them for my case I did not use that option.
Hope this date line helps those who are waiting for their cards. Good luck to every one on forum. I will still be supporting IV and contributing to Wiki as always.

I AM going to face them, confront them, demand them to provide justice, if not I want them to REFUND every penny i have paid so far. If this "I AM" becomes "WE", half the battle won. I am NSC-CSC-NSC person. I opened service request for not receiving FP.
I got a response from NSC after 30 days that my case is waiting for an opening at local ASC for FP. what an idiotic response !!
I called them again and they said that since they have responded to service request, only thing to do is wait 60 days more. they cannot again file service request. I guess I have to just keep trying till I get a good rep.

Honestly, I did not understand jchan's scenario.
AFIK, none will get affected. Please look for my earlier posts regarding I485 Derivative application pre-requisites.
I am waiting to hear from IV-core's or forum-attorney�s interpretation.
Chan is right. If interpretation will start the way you are proposing, it will be sheer disaster for people who didn't file I-485 yet.

Hello All..
Can anyone throw some light on why some cases have not been receipted so far and are pending for any action..No rejections, no receipts no cheques ..nothing..
I see guys already starting to discuss EAD and opening companise etc..
We are still waiting for the ACK fron USICS...
My case was received at NSC on 18Th July by R cook, whose name I havent seen in this frum...and no info so far..Called USICS and talked to 2nd level clerk but no receipted so far.. so they have no info..
Guys anyone can you please tell me what cud be the reason for such delays...

My lawyer is taking his own sweet time to apply. It is frustrating. Do you guys think that there is any chance that they will stop taking 485 applications at some point before 30 june? Please reply...we are worried.

VB date for 2A (family quota) is 08OCT04
VB date for EB3 is now un available.
In my case (EB2). The VB date is 15FEB04. Families VB date is 08OCT04(my spouse). Only 6months diff.

got receipt notice dated 6th of june for 140 premium processing and got call from employer on 8th of june evening saying the case has been approved. approved in less than 3 days.
What service center was it from? Was it a concurrent filing of I140 and 485?

I am the primary Applicant. And my wife is secondary applicant. Can u send me any links or a lawyers contact so i can confirm it
I think it depends on who the primary applicant is in your Canadian PR application. If you are the primary applicant (and used your spouce's qualifications to get the extra points), you should be able to do the landing alone. But if you are the secondary applicant and your wife is the primary then I don't think you can land without her.
I think the rule is that the secondary applicants cannot land until the primary applicant has landed. (So the secondary applicants (spouce, kids) have to land either with the primary applicant or after him.

I will have to check with my attorney. But, my I-140 approval came from TSC but my I-485 application was sent to NSC.
If anyone else has had a similar experience, please post your update here.

My friend got his receipt numbers from TSC yesterday. We filed on the same day, same attorney, Attorney said his will go to TSC and mine will go to NSC. His receipt numbers start with SRC... if it is NSC it will be LIN.
